RENTAL TERMS FOR RENT AT BERGEN INTERNATIONAL CULTURE CENTRE

Bergen International Cultural Center rents and manages parts of the property Fensal, i Kong Oscars gate 15 In Bergen.

Actors who rent premises from the Cultural Center are further defined as "Tenant". Bergen International Cultural Center is further defined as the "Cultural Center".

1. WHO CAN RENT WITH US?

The cultural center wants as many actors as possible to be able to hold events and productions under their own auspices in our premises, with a particular focus on the cross-cultural and multicultural.

The cultural center preferably rents out the premises for open cultural events, course, seminars and conferences.

Members and other actors associated with the cultural center have priority over external tenants.

Member price applies until 2 major events per. year, under the auspices of our members, and the price assumes that the event is open to everyone.

The rental contract must be signed well in advance of the date of renting the premises.

Monday to Thursday afternoons/evenings are reserved for regular activities at the house.

1.2 RESTRICTIONS

The cultural center reserves the right to reject a request for rent or cancel a tenancy under the following conditions:

1.2.1

The cultural center must be a safe and inclusive arena for all tenants. Based on this, the Cultural Center rejects actors and events when the assessment is made, for various reasons, is that the safety of guests, employees, other tenants on the property and the neighborhood cannot be taken care of, or that carrying out the event entails unnecessary or unreasonable inconvenience for them.

1.2.2

Actors who stand for a violent or anti-democratic message.

1.2.3

The event or the organizer represents attitudes that are not compatible with the cultural centre's attitudes, and/or that carrying out the event may damage the reputation of Bergen International Cultural Centre.

1.2.4

Organizations or individuals who do not respect Norwegian law, incites criminal acts or violates the law's provisions for hate speech.

2. AUDIENCE CAPACITY

Main hall 2nd floor

Maks 150 people sitting in the audience in a cinema setup without tables

Maks 120 people sitting in the audience at long tables, f.ex. v/dinner party

Maks 200 people standing in the audience without tables and chairs in the hall, e.g. v/ concerts

Dance hall 4th floor

Maks 50 people sitting in cinema layouts without tables

Maks 30 people sitting at a table in a conference setting

3. PRICES AND BILLING

3.1

Prices include use of sound system via control panel, headlights on stage, projector and screen in the Great Hall. For other rooms, a simple connection for sound systems applies, projector and screen.

3.2

Setup of accessories such as monitor and the like, will be added to the price and must be arranged well in advance.

3.3

For concerts and renting a mixing desk and sound technician, there is a supplement of NOK 5.500,- (Applies up to 10 timer. Per time over 10 timer, DKK 550/hour).

3.4

We also offer full backline hire using our sound engineers. Prices are given on request.

3.5

The tenant must himself apply for a liquor license from the municipality well in advance of the event.

3.6

The total amount must be paid via invoice at the latest 14 days before the event, unless otherwise agreed in the contract. In the event of non-payment, the Culture Center has the right to cancel the event without responsibility for any financial inconvenience this may cause for the customer, guests or the event as a whole.

4. ARRIVAL

4.1

Key fobs are lent by agreement with the general manager and the premises are inspected before the event, Alternatively, you will be met by the supervisor at the agreed time on the day of the event.

4.2

The guard and the house guards are the cultural center's representatives during the event, and tenants must comply with instructions from these.

4.3

CEO, cultural consultant and members of the board have the right to inspect all open events. The general manager and cultural consultant also have the right to inspect all closed events.

5. LESSEE'S RESPONSIBILITY

5.1

The premises must only be used for the agreed purpose and for the agreed period of time.

5.2

The tenant is obliged to follow the applicable Norwegian laws and regulations.

5.3

The tenant is obliged to pay Tono fee or equivalent, unless otherwise agreed with the Cultural Centre.

5.4

Brought alcohol, or containers with unknown liquid contents where alcohol is suspected, will be confiscated without the tenant or their guests being entitled to get this back.

5.6

The tenant is obliged to provide a main person responsible, who must be present throughout the event.

5.6.1

Contact information for the main person in charge must be given to the general manager, as well as the cultural center's guards.

5.6.2

The person in charge is responsible for ensuring that the event complies with applicable laws and regulations, and must only leave the building with the approval of the supervisor.

5.6.3

The person in charge is responsible for spillage, broken glass etc. in the room is dried up and cleaned.

5.6.4

The principal is obliged not to consume alcohol or other drugs before and during the event.

5.7

When promoting and advertising the event on posters and the Internet, the full name of the place/venue must be used:

The abbreviation and name BIKS may NOT be used in promotion after the end of 2017. The cultural center disclaims responsibility if this is still used by tenants/organisers.

6. RULES OF ORDER

6.1

The audience must be out of the premises by 02:30 Friday and Saturday. On weekdays, the event must be finished no later than 00:00, and the public out of the premises by 00:30.

6.2

Sound level: Concerts and other similarly loud music must end no later than 22:00 weekdays and at 23:00 Friday and Saturday, unless otherwise agreed in the contract. After these times you can play lower background music.

6.3

The sale and serving of alcohol can only take place with an approved liquor licence, and the license must always be ready at the bar for any inspection. The tenant must apply for permission from the municipality themselves. Persons who serve alcohol and/or perform security duties (including fire guards) must not have consumed alcohol or other drugs. The hirer is obliged to familiarize himself thoroughly with the applicable drinking regulations in advance of the event.

6.4

Minors must not be allowed into the venue at evening events for adults. In individual cases, the General Manager or the Duty Officer can grant a dispensation from the ban, and the minor must then be accompanied by a guardian approved by the Cultural Centre. The guardianship form must be completed and can be found on our website.

6.5

Donations to an obviously affected person are not permitted.

6.6

It is not permitted to advertise alcohol. All alcohol must be served in either wine glasses or plastic glasses for beer, otherwise bottles/cans must be opened before delivery.

6.7

Escape routes must not be blocked with chairs, bord, decorations or the like. It is not permitted to use flammable materials as decorations.

6.8

All use of smoke machine, fireworks, confetti and candles are prohibited.

6.9

Hanging posters at the cultural center is only permitted in designated places. It is not permitted to hang posters or decorations with tape or a stapler on walls, curtains or the like.

6.10

This applies to a general ban on films in the Kultursenteret's common areas. Employees, volunteers or guests cannot be filmed without their explicit consent. Filming during events or at other events must be approved separately by the Culture Centre.

7. END

7.1

The event and all sales must be finished by the end of the service at the latest 02.00. The audience must be out of the premises by 02:30 Friday and Saturday. On weekdays, the event must be finished no later than 00:00, and the public out of the premises by 00:30.

7.2

Food service must end at least one hour before the end of the event.

7.3

7.3.1

All glasses, coffee cups, plates, cutlery, pans and other kitchen equipment must be washed and put away in cupboards and drawers, in the same place it was found.

7.3.2

The dishwasher must be rinsed, is emptied and switched off.

7.3.3

All table, benches and bar counters must be washed.

7.3.4

All windows and doors must be closed and locked.

7.3.5

Furniture is stacked in its own trolleys against the wall.

7.3.6

The floor is swept and spills are wiped up.

7.3.7

Rubbish must be cleaned and thrown in the bin in the boss room. It can be thrown to the maximum 2 garbage bags, and if one has more than this, the tenant must take it with them.

7.3.8

The tenant must also take all deposits and all glass/metal with them.

7.3.9

7.4

When the premises have been cleaned, the tenant must contact the duty manager for approval and locking of the premises. In the event of insufficient cleaning, the supervisor can ask the tenant to correct this before the premises are approved. If the tenant leaves the premises without approval, the tenant may be billed a fee for cleaning in accordance with part 8 on sanctions section. 5.

The premises must be cleaned and emptied within one hour of the end of the event, or after the pouring stop.

8. SANCTIONS & COMPENSATION

8.1

The cultural center can invoice the tenant a fee for breach of the lease terms, limited to NOK. 15.000,-. The fee is in addition to compensation for damage/loss for which the tenant is responsible.

8.2

The tenant can be banned from the cultural center for up to one year.

8.3

The tenant is fully responsible for all damages and all losses, directly and indirectly, which the cultural center would be subjected to as a result of the event. The cultural center itself decides which suppliers will be responsible for repairs or be responsible for purchasing replacement objects.

8.4

Point 1, 2 and 3 does not prevent the Cultural Center from choosing to hold individuals responsible for damages and losses.

8.5

If the room is not sufficiently cleaned, or the Cultural Center must be responsible for clearing and extra cleaning of this after the event, the Cultural Center can invoice the tenant for this up to NOK 5.000,-.

9. PRIVACY

9.1

Bergen International Cultural Center stores contact information for the tenant and contact person in connection with the event. This is used for follow-up of the event, and information work in connection with the use of the premises at the Bergen International Cultural Centre. The tenant agrees to this by accepting the terms and conditions for renting premises at the Bergen International Cultural Centre.

9.2

The tenant and contact person can at any time withdraw their consent and have the information removed by sending an inquiry to post@bergeninternasjonalekultursenter.no

10. CANCELLATION- AND AMENDMENT TERMS

10.1

Cancellation within 1 month before the confirmed event: free

10.2

Cancellation until 14 days before the confirmed event: half rent is invoiced

10.3

Cancellation less than 14 days before the event: the entire rent is invoiced

10.4

The need for technical services may incur additional rental costs. We cannot guarantee that equipment that needs to be hired can be acquired at short notice.

11. BERGEN INTERNATIONAL CULTURAL CENTER ITS EDITORIAL RESPONSIBILITY

The cultural center will at all times make editorial assessments regarding potential tenants and their programme. Norwegian law places some restrictions on statements that tenants undertake to comply with. 12. FIRE INSTRUCTIONS FOR TENANTS

12.1

The tenant is obliged to familiarize himself with fire instructions and escape routes. An overview plan of escape routes can be found on the walls in all rooms for the public.

12.2

The person who detects fire:

12.2.1

Notifies our guards and by manual fire alarm.

12.2.3

Attempts to extinguish or prevent the fire from spreading, if you do not expose yourself to danger.

12.2.4

Checks that fire doors in the area are closed.

12.3

Those who are not involved in firefighting or have other duties when the alarm goes off, helps calm the crowd, show them escape routes and release/help them to the assembly point.
